1) Who we are and what we offer
Netzerly is an AI consulting business. Our services include the AI Assessment, a one-time $999 service consisting of a 45-minute consultation call and a written recommendation of up to nine AI tools tailored to your business; and AI Concierge, done-for-you services in which we build custom AI tools and/or implement recommended tools, custom-priced based on scope and quoted before work begins. By using the Netzerly website or purchasing our services, you agree to these Terms & Conditions. If you do not agree, please do not use the site or services.
2) The $999 assessment credit
If you engage Netzerly for AI Concierge implementation, the $999 AI Assessment fee is credited toward your Concierge project. The credit applies once, to a single Concierge engagement, is valid for 90 days after your assessment, and only if you proceed with Netzerly.
3) Fees and payment
The AI Assessment fee is $999, charged at booking through our payment provider (Wix Payments/Stripe). Concierge fees are set out in a separate written quote and are due as stated there. All fees are in U.S. dollars and exclusive of any applicable taxes.
4) Scheduling, rescheduling, and cancellations
Assessment calls are scheduled through our online booking system. You may reschedule up to 48 hours before the appointment at no charge. The $999 Assessment fee is non-refundable once the assessment call has taken place; if you cancel at least 48 hours before the scheduled call and before any work has begun, you may request a full refund.
5) No guaranteed results
Our assessments and recommendations are advisory. We share our professional opinion based on the information you provide. We do not guarantee any specific outcome, time savings, revenue, cost reduction, or result. Decisions about whether and how to adopt any tool are yours.
6) Third-party tools and costs
The AI tools we recommend or implement are provided by third parties under their own terms and pricing. You are responsible for your own accounts, subscriptions, fees, and compliance with those terms. Netzerly is not responsible for third-party tools' availability, performance, or changes.
7) Your responsibilities
You agree to provide accurate information, to have authority to share any business data you provide, and to use tools and recommendations lawfully.
8) Intellectual property
The Netzerly website, brand, and materials are owned by Netzerly. Custom deliverables created for you under a Concierge engagement are addressed in that engagement's agreement; our general methods, know-how, and templates remain ours.
9) Confidentiality
Each party will keep the other's non-public business information confidential and use it only to perform or receive the services.
10) Limitation of liability
To the maximum extent permitted by law, Netzerly is not liable for indirect, incidental, special, or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid Netzerly for the specific service giving rise to the claim.
11) Indemnification
You agree to indemnify and hold Netzerly harmless from claims arising out of your use of the services or any recommended or implemented tools, except to the extent caused by our gross negligence or willful misconduct.
12) Governing law
These Terms are governed by the laws of the State of California, and disputes will be handled in the state or federal courts located in San Luis Obispo County, California.
13) Changes
We may update these Terms; the version posted here with the current effective date applies.
